Terms and Conditions

These General Terms and Conditions (hereinafter referred to as: GTC) contain the general terms and conditions applicable to the booking of appointments through the https://barathfoto.hu website operated by Zsuzsanna Szabó-Baráth, a sole proprietor, as well as to the photography service contracts concluded on the basis thereof.

By finalizing the appointment booking via the website, the Client declares that he/she has become acquainted with and understood the provisions of the present GTC before the booking and accepts them as binding on him/herself.

  1. Scope of the GTC

The scope of this GTC extends to the photographic services advertised by the Service Provider through the https://barathfoto.hu website or bookable in the online appointment booking system, in particular:

  • for family photography;
  • for pair photography;
  • for children’s photography;
  • portrait photography;
  • professional and business portrait photography;
  • and additional photography services available in the online booking system.

In the case of institutional photography for kindergartens and schools, as well as other services provided on the basis of an individual, separate offer, the provisions of the present GTC shall apply with the exceptions specified in the individual offer or in a separate contract.

If the provisions of the individual agreement and the present GTC differ from each other, the provisions of the individual agreement shall prevail.

  1. Basic concepts

Client: the natural or legal person or other organisation who uses the Service Provider’s services or makes an appointment for it.

Consumer: a natural person acting outside the scope of his or her profession, self-employment or business activity as defined in the Civil Code.

Service: the photographic service provided by the Service Provider.

Reservation: an electronic declaration of contract submitted through the online appointment booking system integrated into the Website for a specified service, day and time.

Booking system: the Amelia appointment booking system integrated into the Website.

  1. Essential features of services

A detailed description of the services provided by the Service Provider can be found on the My Services page of the website and on the appointment booking interface of the given service.

The content of the specific service shall be defined in particular:

  • type of photography;
  • duration;
  • location or how the location is determined;
  • the fee for the service;
  • any additional services;
  • and the terms and conditions for the photos to be handed over

The Service Provider is entitled to provide a personalized offer in the case of photography with different content or individual needs.

  1. The process of online appointment booking

The Client can book an appointment through the appointment booking interface on the website.

During the booking, the Client:

  1. selects the available day and time;
  2. provide the personal and contact information required for the reservation;
  3. checks the data, time and fee of the selected service;
  4. gets to know and accepts the present GTC and the Privacy Policy;
  5. By finalizing the booking process, you will submit your reservation.

The Client is obliged to check the provided data before finalizing the booking. The online booking system provides an opportunity to correct the data or return to previous steps before finalising the booking.

The Service Provider shall not be liable for the consequences arising from erroneous or inaccurate data, if the error occurred in the Client’s sphere of interest.

  1. Conclusion of the contract

Online appointment booking qualifies as signing a contract electronically.

By finalizing the reservation, the Client makes a contractual declaration with a payment obligation for the use of the selected service.

The Service Provider will send an automatic confirmation e-mail about the successfully submitted reservation to the e-mail address provided by the Client.

The contract is concluded when the electronic message sent by the Service Provider containing the acceptance of the booking and the confirmation of the appointment becomes available to the Client.

The confirmation contains or makes clearly identifiable in particular:

  • the service you have booked;
  • the name of the Client;
  • the date and time of the reservation;
  • the fee for the service or how it is determined;
  • and the data necessary to identify the booking.

If after the submission of the reservation there is only a technical confirmation of the receipt of the reservation request, this in itself does not mean that the reservation is accepted by the Service Provider. In such a case, the contract is concluded with a separate acknowledgment of acceptance by the Service Provider.

If the Client does not receive an electronic confirmation of the receipt of the booking within 48 hours at the latest, the Client shall be exempt from the obligation to make an offer.

The language of the contract is Hungarian.

The contract to be concluded shall not qualify as a written contract, it shall not be separately filed by the Service Provider. The data of the reservation and the electronic confirmation may be stored in the IT system of the Service Provider in accordance with the relevant data management and accounting rules.

The Service Provider does not submit to the provisions of the Code of Conduct.

  1. Payment obligation for the reservation

The photography services provided by the Service Provider can be used for a fee.

Finalizing the reservation creates a payment obligation.

Before finalizing the reservation, the Customer must be clearly displayed:

  • the selected service;
  • its essential characteristics;
  • the selected date;
  • the full price of the service, plus tax, or, if it cannot be determined in advance, the method of its unambiguous calculation;
  • and any additional costs that may be incurred.

The name of the button or function that completes the reservation must clearly indicate that its use is subject to payment.

  1. Service fees and payment

The current fee of the services is included in the Website, the appointment booking system or, in the case of individual services, in the offer sent by the Service Provider.

The fees shown are tax-exempt / gross amounts including VAT.

Possible payment methods:

Bank transfer / cash / credit card

If the service is accompanied by an advance payment or appointment booking fee, the exact amount, payment deadline and settlement conditions will be displayed to the Client before the booking is finalized.

An amount paid under the “advance”, “reservation fee” or other designation shall only qualify as a deposit under the Civil Code if it is expressly and unambiguously defined by the Parties as a deposit.

  1. Date and location of the photo shoot

The time of the photo shoot is the time selected in the online system and confirmed by the Service Provider.

The exact location of the photo shoot – if it has not been determined at the time of booking – will be agreed upon by the Parties electronically or by phone before the photo shoot.

The Client is obliged to appear at the agreed time and place in a condition suitable for starting the photo shoot.

In the event of a delay by the Client, the Service Provider shall not be obliged to extend the original end date of the reservation if it would affect the Service Provider’s next reservation or other obligation.

In the event of a significant delay, the Service Provider is entitled to perform the photo shoot for a shorter period of time, or in the event of a delay of such a magnitude that the service can no longer be performed on the merits, the rules on non-attendance are applied.

  1. Change and cancel an appointment

The Client may indicate the modification or cancellation of the booked appointment by contacting one of the following contact details:

The Client is entitled to modify or cancel the booked appointment at least one hour/day before the time of the photo shoot free of charge.

In case of cancellation within an hour/day before the photo shoot, the Service Provider is entitled to a failure fee equal to -……% of the service fee .

In case of non-attendance without prior cancellation, the Service Provider ………….

The cancellation conditions under this section do not limit the Consumer’s right of withdrawal or termination under the law.

The Service Provider may deviate from the above conditions in reasonable cases – especially in the event of illness, accident or other unexpected circumstances – on the basis of individual consideration.

  1. Time change initiated by the Service Provider

If the photo shoot cannot be held at the booked time for reasons arising in the Service Provider’s sphere of interest, the Service Provider will notify the Client thereof as soon as possible and offer a new date if possible.

If the Parties are unable to agree on a suitable new date, the amount paid in advance by the Client for the given service shall be refunded by the Service Provider.

In the case of outdoor photography, the modification of the date due to weather conditions does not qualify as a breach of contract by the Service Provider. In such a case, the Parties shall agree on a new date.

  1. Fulfillment of the service

The Service Provider performs the service in accordance with its professional knowledge, in accordance with its visual and professional approach presented on the Website.

The Client acknowledges that the photographic service is a creative activity, therefore the Service Provider’s reference materials or the results of other previous photo shoots cannot be expected to produce exactly the same end result.

The detailed conditions for the selection, post-production, delivery, quantity and deadline of the images are set out in the description of the given service, the individual offer or the separate agreement of the Parties.

The Service Provider will only hand over raw, unedited image files on the basis of a separate agreement.

  1. Copyright and use of photos

The photos taken by the Service Provider are protected by copyright.

The copyright belongs to the Service Provider, unless the Parties agree otherwise.

In the case of a private photo shoot, the Client may use the photos provided to him for his own, non-commercial purposes, in particular by sharing them on his own social media platforms and making copies for private purposes.

In the case of use for business or commercial purposes, the exact extent of use is determined by a separate agreement between the Parties or a description of the service.

The Service Provider may only use the photos taken of the Client in its own portfolio, on its website, on its social media platforms, in competitions or for advertising purposes, if the person concerned has given the necessary consent or there is another appropriate legal basis for the use.

The use of the service cannot be made conditional on consent to the use of images for marketing purposes.

  1. Consumer right of withdrawal and termination

This clause applies only to the Client who qualifies as a Consumer.

In the case of a service contract concluded at a distance, the Consumer shall have the right of withdrawal without justification within 14 days from the date of conclusion of the contract.

If the Consumer expressly requests the Service Provider to start the performance of the service before the expiry of the 14-day withdrawal period, the performance may only be commenced in accordance with the Consumer’s express request to do so.

The Consumer acknowledges that if the service starts before the expiry of the 14-day deadline at the express request of the Consumer and then terminates the contract before the full completion of the service, he is obliged to pay a fee proportionate to the service already provided by the date of the notice of termination.

After the full performance of the service, the Consumer loses his right of withdrawal if the performance:

  • with his express prior consent; and
  • At the same time, the Student acknowledged that after the performance of the service in its entirety, it loses its right of withdrawal.

In the case of services specified by law in respect of which the right of withdrawal is excluded, the provisions of the relevant law shall apply.

  1. Exercising the right of withdrawal

The Consumer shall exercise his right of withdrawal or termination:

  • using the model statement in the annex to these GTC;
  • any other unambiguous statement to that effect

practice.

When using the electronic withdrawal function, the Consumer has the opportunity to specify:

  • your statement of withdrawal;
  • name;
  • the information necessary to identify the relevant booking;
  • and the electronic contact details to which you request confirmation of withdrawal.

The Service Provider shall confirm the receipt of the electronic withdrawal declaration without undue delay on a durable data carrier, indicating the content of the withdrawal and the date and time of sending.

Withdrawal is deemed to have been exercised within the deadline if the Consumer sends the declaration of withdrawal before the expiry of the 14-day deadline.

  1. Refund in case of withdrawal

In the event of statutory withdrawal, the Service Provider shall refund the amount paid by the Consumer in connection with the contract in question within 14 days of becoming aware of the withdrawal at the latest.

As a general rule, the refund will be made in the same way as the original payment method, unless the Consumer expressly consents to the use of another refund method.

  1. Warranty

In the event of defective performance by the Service Provider, the Client may enforce a claim for implied warranty in accordance with the provisions of the Civil Code.

It is considered a defective performance if the service does not comply with the requirements specified in the contract or the law at the time of performance.

A subjective difference in taste arising from the creative nature of the photographic service does not in itself qualify as a defective performance, if the Service Provider has acted in accordance with the agreement, the advertised characteristics of the service and the professional requirements.

The Consumer’s statutory warranty rights are not limited by the present GTC.

  1. Complaint handling

The Client may report a complaint related to the service, the booking or the Service Provider’s activity at the following contact details:

The Service Provider shall respond to the written complaint in writing and on the merits within the deadline set out in the consumer protection legislation.

If the complaint is rejected, the Service Provider shall inform the Consumer of the authority or conciliation body to initiate the procedure with the complaint.

  1. Conciliation Board Procedure

The Consumer is entitled to turn to a conciliation board in the event of a consumer dispute.

The Consumer may also initiate the procedure of another competent conciliation body under the conditions specified in the law.

The Service Provider shall be obliged to cooperate in the proceedings of the conciliation board.

The current contact details of the conciliation bodies are available on the website of the Hungarian Chamber of Commerce and Industry.

  1. Consumer Protection Authority

In the event of a violation of consumer protection rights, the Consumer may turn to the territorially competent government office acting as the consumer protection authority.

The Parties are also entitled to initiate legal proceedings to settle their dispute.

  1. Data management

The Service Provider processes the personal data obtained during the appointment booking and the performance of the service in accordance with the effective data protection legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

The detailed rules related to booking appointments, contact, performance of the contract and other data processing are contained in the current Privacy Policy available on the Website.

  1. Technical conditions

To conclude a contract through the Website, a browser with an internet connection and a device that is suitable for using the Website and the appointment booking system is required.

The Service Provider shall not be liable for any unsuccessful reservation resulting from the fault of the Client’s internet connection, IT device or services operating in its sphere of interest.

In the event of a temporary malfunction of the online booking system, the Client may request assistance at the Service Provider’s e-mail address or phone number.

  1. Accessibility and modification of the GTC

The effective GTC is continuously available on the Website in such a way that it can be displayed, downloaded and permanently saved by the Client.

The provisions of the GTC in force at the time of conclusion of the contract always apply to the booking.

The Service Provider is entitled to unilaterally amend the present GTC for the future. The amendment does not change the terms and conditions of the contracts already concluded to the detriment of the Consumer.

  1. Governing Law

Issues not regulated by the present GTC are subject to the rules of Hungarian law, in particular:

  • Act V of 2013 on the Civil Code;
  • Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services;
  • Act CLV of 1997 on Consumer Protection;
  • Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses

provisions in force at all times.
